Echoes Terms of Use

Please read these Terms of Use ("Terms") carefully before using the Echoes: Echoes of the City mobile application (the "App") operated by Ziyad Alsuhaymi ("we," "us," or "our").

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the App.

2. Description of Service

Echoes is a memory capture application that allows you to record photos, ambient audio, location, and environmental data as "echoes." The app processes data on your device using machine learning and stores all content locally.

3. User Content

You retain full ownership of all photos, audio recordings, notes, and other content you create using the App.
All content is stored locally on your device and is not uploaded to our servers.
You are solely responsible for the content you capture and any legal implications of recording audio or taking photos in your jurisdiction.
You agree not to use the App to capture content that violates any applicable laws, including privacy and recording consent laws.

4. Subscriptions & Purchases

The App offers a free tier with daily capture limits and advertisements.
Echoes Pro is available as an optional auto-renewable subscription (monthly or yearly) that removes ads, increases limits, and unlocks premium features.
Payment is charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
You can manage or cancel subscriptions in your Apple ID Account Settings.
Refunds are handled by Apple according to their refund policy.

5. Permitted Use

You agree to use the App only for its intended purpose and in compliance with all applicable laws. You may not:

Reverse engineer, decompile, or disassemble the App.
Use the App for any illegal or unauthorized purpose.
Attempt to interfere with the proper working of the App.
Remove any copyright or proprietary notices from the App.

6. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

7. Intellectual Property

The App, including its design, code, graphics, and branding, is owned by Ziyad Alsuhaymi and is protected by copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, arising out of or in connection with your use of the App.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the App after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, without regard to its conflict of law provisions.
